Stop Loss Special Pay

Approximately 39,000 current and former Airmen who were involuntarily held on active duty beyond an approved separation or retirement date as a result of stop loss between Sept. 11, 2001, and Sept. 30, 2009, may be eligible for a Retroactive Stop Loss Special Pay compensation of $500 for each whole or partial month they were affected.

The 2009 War Supplemental Appropriation Act set aside $534.4 million for the Retroactive Stop-Loss Special Pay compensation authority. The Air Force used stop loss for Operation Enduring Freedom in 2001 and 2002 and Operation Iraqi Freedom in 2003. The Stop Loss Program may have affected approximately 39,000 Airmen.

The deadline for Airmen to file their claim has been extended until Oct. 21, 2011.

tabEligibility 
The Retroactive Stop Loss Special Pay authority compensates active, retired and former servicemembers as well as members of the Reserve component who served on active duty while their enlistment or period of obligated service was involuntarily extended, or whose eligibility for retirement was suspended as a result of stop loss. Airmen who were involuntarily held on active duty beyond an approved separation or retirement date as a result of stop loss between Sept. 11, 2001, and Sept. 30, 2009, are eligible for the special pay.

Individuals discharged from the armed force under other than honorable conditions are not eligible to collect payment under this authority.

Due to officers having an indefinite date of separation, only those with an actual approved separation date at the time of stop loss would be eligible.
tabPayments 
Active, retired and former Airmen or family members applying on behalf of an eligible member must provide direct deposit information on Department of Defense Form 2944, Claim for Retroactive Stop Loss Payment. The goal by personnel officials is to immediately adjudicate all claims, however, the standard processing time is 30 days from the date the application is received.

The Defense Finance and Accounting Service will review approved claims and disburse payments by electronic funds transfer to individuals' accounts. Applicants must ensure they provide proper routing and account numbers for their banking institutions on their claims forms when submitting their requests.

Eligible Airmen will be paid $500 for every month or partial month they were involuntarily held on active duty as a direct result of stop loss. For those eligible, DFAS will also review approved claims to determine if the combat zone tax exclusion applies.

Personnel officials will keep applicants informed of the status of their claim. Should notice not be made within six weeks, applicants can call the Total Force Service Center at (800) 525-0102 to check the status of their claim. Active, retired and former Air Force members may also check on the status of their claim by e-mailing afpc.dpsos.stoploss@randolph.af.mil; Reserve members may e-mail arpc.contactcenter@arpc.denver.af.mil.

Separations and retirements officials from either AFPC or ARPC will review all claim forms and substantiating documentation to approve or disapprove the application.

Claims with insufficient documentation will be held in pending status, and the applicant will be notified about the pending approval and what further documentation is required.

Claims not approved will be returned to the applicant with an explanation for disapproval as well as the appeals process.

Personnel officials will attempt to process all applications for stop loss with information obtained on the completed Department of Defense Form 2944, Claim for Retroactive Stop Loss Payment. Should officials require any additional supporting documents, they will inform applicants and direct them to the appropriate office.

Former active-duty Airmen who retired or separated before Oct. 1, 2004, can request copies of records by visiting the National Personnel Records Center Web site for record request instructions: www.archives.gov/st-louis/military-personnel/ or use www.archives.gov/veterans/evetrecs.

Family members of deceased or incapacitated Airmen
The next of kin of a deceased or incapacitated veteran may use www.archives.gov/veterans/evetrecs to order a copy of military records, or visit the National Personnel Records Center Web site for record request instructions. Reserve component members may request documents through ARPC at https://arpc.afrc.af.mil/vPC-GR/.

Authorized Source Documents
Examples of authorized source documents may include but are not limited to the following:
  • DD Form 214, Certificate of Discharge and/or DD Form 215, Correction to DD Form 214
  • Personnel record of enlistment or re-enlistment document recording original expiration of service date
  • Approved retirement memorandum or orders establishing retirement prior to actual date of retirement as stipulated on DD Form 214 or DD Form 215
  • Approved resignation memorandum or transition orders establishing a separation date prior to actual date of separation as stipulated on DD Form 214 or DD Form 215
  • Revocation of retirement or separation orders
  • Copy of initial retirement or separation order with subsequent final order enacting final retirement or separation, which demonstrates a change in orders
  • Copy of request to Re-establish DOS Retirement Date, upon release of Air Force specialty code from stop loss
  • Copy of Air Force Form 1160, Military Retirement Actions; Air Force Form 780, Officer Separation Actions; Air Force Form 31, Airman's Request for Early Separation/Separation Based on Change in Service Obligation; or Air Force Form 973, Request and Authorization for Change of Administrative Orders
  • Involuntary DOS extension memorandum (2003 only)
  • Signed documentation or affidavit from knowledgeable officials from the individual's chain of command
  • Other documentation an individual feels may support his or her claim
Certain source documents may not apply to both stop loss periods. Should any of the above supporting documents not be available, AFPC and ARPC officials will review the claim application to determine if other records exist to substantiate claim.
tabAppeals Process 
Applicants who are notified that their requests were not approved or do not agree with the number of months for which it was approved have the option to first submit a Memorandum of Appeal. In this letter, they should provide any explanation or justification as to why they believe the denial of retroactive pay or approved number of months was made in error. The letter of appeal should also include any additional supporting documents not previously considered that clearly indicates qualification under the provisions of Retroactive Stop Loss Special Pay.

Air Force Board of Correction to Military Records
If an initial appeal is denied, the claimant may file an appeal to the Air Force Board of Correction to Military Records as the final appellate process. They can submit a DD Form 149, Application for Correction of Military Record, and any supporting documentation by mail to: Board for Correction of Air Force Records, SAF/MRBR, 550-C Street West, Ste. 40, Randolph AFB, TX 78150-4742. All applicable sections of the form must be completed.
